Insurer loses bid to appeal indemnity costs issue in unusual case where expert agreed to cover its costs

An insurer has failed to convince a judge that a medical expert who agreed to cover its costs in a whiplash case should be ordered to pay on the indemnity basis. Ageas Insurance appealed against the ruling at Liverpool County Court, but the appeal was rejected by the High Court.

Small claims increase “unlikely” next year, MASS says

An increase in the small claims limit for whiplash cases is “unlikely” before the end of next year, the Motor Accident Solicitors Society has said. MASS said the Ministry of Justice would consult on whether the increase should be applied more widely.

MedCo, the portal for medical evidence in whiplash cases, could be extended to hearing loss claims, a senior civil servant at the Ministy of Justice has suggested. Richard Mason also said that the government had confidence in the scheme.

Finally – the number of MROs registered with MedCo is revealed

There are 175 medical reporting organisations – including 14 ‘tier 1’ providers – registered with MedCo, the government’s system for selecting experts in whiplash cases, it was revealed yesterday. Martin Heskins, a director of MedCo, also admitted that it gets “complaints about everything”.

Not-for-profit association to provide MedCo service for direct experts

A not-for-profit association is to launch a new service next month for claimants wanting to instruct medical experts directly via MedCo. The aim is to ensure experts are more independent and keep most of their fees.

MedCo regime goes live

All medical reports for whiplash claims must now be brought under the MedCo system after it formally went live yesterday. Claimants will be given the choice of one “high-volume national” medical reporting organisation and six smaller ones, or seven medical experts.
